Phone Zap - Terms & Conditions Of Service

Please read the following terms and conditions carefully, as they form the agreement between us. If you do not agree to these terms and conditions, you must not use the service and must not proceed with delivery of any Phone Zap Character Voice Greetings. By using the Service after October 11, 2001 you are agreeing to be bound by this Agreement, including all amendments made to date.

The Phone Zap 1900 telephone service (hereafter referred to as “the service”) and web domain - www.phonezap.com.au is operated by Phone Zap. Phone Zap is a registered business in Victoria, Australia (RBN: B1593343B).

Service cost is $2.95 per minute including GST. Higher from Mobiles and Public Phones. You pay only for your call time. Children aged under 14 must have their parents or guardians permission before using this service. You must be the bill payer to use our service.

The Phone Zap 1900 telephone service is delivered by TelAds Communications Group of North Melbourne, Victoria. TelAds provide the indial IVR system to operate this service.

The Phone Zap service works with ALL types of mobile phones located within Australia.

To operate the Service, users must record their name in a voice message. It is mandatory for users of the service to honestly state their name as part of their voice greeting. Messages without recorded voice input from the sender will not be delivered. Users creating and delivering lewd or offensive messages or messages generally considered to be offensive to the general population will be BANNED from the service after a complaint has been lodged with Phone Zap. Recipients should be aware that Phone Zap has no control over the content delivered by senders other than our entertainment original content. The service is in every instance to be used lawfully. Users are forbidden from using false names. Furthermore users must not send greetings on behalf of other people or entities without their permission nor are users permitted to send our service to persons with whom they are not well acquainted.

Phone Zap prohibits the transmission, of unwanted or offensive content. Prohibited transmissions include without limitation, profane or sexually explicit messages, illegal or explicit language or material, sexual or otherwise. As a sender of Phone Zap greetings it is your responsibility, and you agree to comply with all requirements, legal or other. Additional prohibitions include use of our service to promote any commercial good scheme plan or service, pyramid or chain letters and fraudulent or criminal offer. Even though all of this is strictly prohibited, there is a small chance that a recipient must become exposed to such items and as a recipient you further waive your right to any damages (from any party) related to such exposure.

You cannot play third party copyrighted material into the Voice section of your greeting.

Audio content provided by the Phone Zap service is under the editorial control of the management of Phone Zap. All rights (including copyright) in the audio content are the property of, and reserved by, Phone Zap. The audio service must not, either in whole or in part, be saved, copied, deleted, mirrored, reproduced or in anyway altered whatsoever without the prior written consent of Phone Zap.

Rebroadcasting of any of the service via any media is Strictly Prohibited without prior authorisation from Phone Zap.

We aim to deliver your Phone Zap greeting within 5 minutes of the completed processing of your request via the voice channel of an operating mobile telephone. The service will only deliver to Mobile Telephones. We make no guarantees as to the viability or connectivity of the mobile telephone network in the recipient’s particular location at the time of the call delivery.

It is your responsibility as sender to ensure the services recipient has an operating reliable mobile telephone ready with which to receive the service.

In the event of an engaged or switched off telephone the service will be delivered to a MessageBank type service or if no MessageBank service is operating the service will retry the delivery 3 times over the following 180 minute period. The service will not be delivered successfully to mobile telephones operating the Telstra memo (or similar) messaging service or any other services that rely on delivery of an SMS message to the recipients mobile telephone alerting them to the callers message and/or telephone number. Costs associated with the retrieval of a Phone Zap greeting from a messaging service rest solely with the recipient. In some cases we may not be able to guarantee a successful delivery to a MessageBank service.

Transmission of the messages to any mobile phone located outside of Australia may incur a redirection, roaming or other additional charge billed by the recipients Telco. Phone Zap is not liable for any message diversion or retrieval costs.

In the event of a major occurrence or incident, including Civil Unrest, War, Terrorist Act, Acts of God or other events not under the control of Phone Zap, Phone Zap reserves the right to suspend or cancel its service and not deliver any messages past the time of the occurrence or incident.

Our system only delivers the Voice audio you record; it does not transmit your phone number, location or any personal information ( with the exception of anything included in your voice recording).

Phone Zap reserves the right to occasionally incorporate any advertising or commercial offer within the message.

All the material delivered (published) through the service is for entertainment purposes only. Users may utilise this service to send messages to a recipient for the express purpose of entertainment only. Phone Zap does not warrant the accuracy, adequacy, or completeness of such information.

Phone Zap reserves the right to update, replace or change entertainment messages contained on the service at any time.

Phone Zap does not accept the responsibility for any loss suffered as a result of reliance upon the accuracy or currency of information contained on the service.

Phone Zap does not accept any responsibility for loss or damage, however caused (including through negligence) suffered by any person or body relying directly or indirectly on any information contained within the service.

Phone Zap respects your right to privacy and will never release your telephone number to any party. When you send a Phone Zap electronic greeting, the information you provide to us is used only to customise your greeting with your name and your recipient's name, and to enable us to deliver your greeting. Telephone numbers and users or recipients names and details are NOT sold, compiled into any type of mailing list, or otherwise used for any type of solicitation. Please be aware you may be contacted by Phone Zap staff for quality assurance and research purposes. Phone Zap does not support, condone, tolerate or produce SPAM or illicit unauthorised messaging.

All messages in the “Celebrity Take Off’s” section are impersonations and do not feature the voice of the celebrity.
We have no knowledge of any infringement of copyright on our site, or in the audio we provide. However, if you believe we may have infringed upon your copyright or trademark, contact us at support@phonezap.com.au so we can rectify the situation as soon as possible and if need be remove any offending material.

The laws in force in the state of Victoria, Australia govern these terms and conditions.
